1. Scope & Acceptance / Geltungsbereich & Annahme

These Terms govern the checkout and related services when you expressly accept them. Your rights in a copy of the Software also depend on the copyright license supplied with that copy. These Terms do not revoke rights in earlier GPL copies. The service provider is Johannes Habel.

Diese AGB gelten für Checkout und zugehörige Dienste, wenn Sie ihnen ausdrücklich zustimmen. Ihre Rechte an einer Programmkopie richten sich auch nach der mit dieser Kopie gelieferten Urheberrechtslizenz. Diese AGB widerrufen keine Rechte an früheren GPL-Kopien. Anbieter des Dienstes ist Johannes Habel.

2. Minimum Age / Mindestalter

You must be at least 18 years of age to use this Software or to purchase a license. By using the Software, you represent and warrant that you are at least 18 years old and possess full legal capacity to enter into a binding agreement (§ 2 BGB — volle Geschäftsfähigkeit). If you are under 18 years of age, you are prohibited from using this Software and from making any purchases.

Sie müssen mindestens 18 Jahre alt sein, um diese Software zu nutzen oder eine Lizenz zu erwerben. Mit der Nutzung der Software versichern Sie, dass Sie mindestens 18 Jahre alt sind und die volle Geschäftsfähigkeit besitzen, um einen verbindlichen Vertrag abzuschließen (§ 2 BGB). Wenn Sie unter 18 Jahre alt sind, ist Ihnen die Nutzung dieser Software und jeglicher Kauf untersagt.

3. Product Description / Produktbeschreibung

Porn Fetch is a source-available software tool designed for downloading videos from the internet. A future application release expressly marked with the Porn Fetch Source-Available License 1.0 is governed by that license for application-owned material; independently licensed components keep their own terms. Earlier GPL-licensed copies keep the rights granted with them. Premium features currently include video qualities above 720p. The current test licensing design uses up to ten installation slots and time-limited offline permits; a software copy does not include a premium entitlement.

Porn Fetch ist ein quelloffenes, aber nicht als Open Source lizenziertes Programm zum Herunterladen von Videos aus dem Internet. Eine zukünftige, ausdrücklich mit der Porn Fetch Source-Available License 1.0 gekennzeichnete Version unterliegt für die eigenen Programmteile dieser Lizenz. Für Fremdkomponenten gelten deren eigene Lizenzen. Frühere GPL-Kopien behalten ihre bereits eingeräumten Rechte. Zu den Premium-Funktionen gehören derzeit Videoqualitäten über 720p. Die Test-Lizenzierung sieht bis zu zehn Installationen und zeitlich begrenzte Offline-Berechtigungen vor; eine Programmkopie enthält keine Premium-Berechtigung.

4. Right to Source Code Inspection / Recht zur Quellcode-Einsicht

You have the right to inspect, audit, and verify the full source code of Porn Fetch at any time. The complete source code is publicly available at the official project repository. This transparency ensures that you can verify the Software does not contain malicious code, hidden data collection, or any functionality beyond what is described.

Sie haben jederzeit das Recht, den vollständigen Quellcode von Porn Fetch einzusehen, zu prüfen und zu verifizieren. Der gesamte Quellcode ist öffentlich im offiziellen Projekt-Repository verfügbar. Diese Transparenz gewährleistet, dass Sie überprüfen können, dass die Software keinen schädlichen Code, versteckte Datenerhebung oder Funktionen über das Beschriebene hinaus enthält.

The application license also permits modification and private sharing with friends and family, including privately modified copies. Public forks may be shared only while they preserve the effective premium checks and required notices. Publicly distributing or hosting a version that disables premium licensing is outside that permission. Each recipient needs their own valid premium entitlement for premium features in an unmodified release.

Die Anwendungslizenz erlaubt außerdem Änderungen und die private Weitergabe an Freunde und Familie, auch von privat geänderten Kopien. Öffentliche Forks dürfen nur mit wirksamer Premium-Prüfung und den erforderlichen Hinweisen verbreitet werden. Die öffentliche Verbreitung oder Bereitstellung einer Version mit ausgeschalteter Premium-Lizenzierung ist nicht gestattet. Für Premium-Funktionen einer unveränderten Version benötigt jeder Empfänger eine eigene gültige Berechtigung.

Users who agree to these Terms also agree not to publish targeted step-by-step instructions, patches, or code snippets whose principal purpose is to disable Porn Fetch's premium checks. This does not restrict independent discussion, criticism, security research, or mandatory legal rights, and it does not purport to bind people who did not accept these Terms.

Nutzer, die diesen Bedingungen zustimmen, verpflichten sich außerdem, keine gezielten Schritt-für-Schritt-Anleitungen, Patches oder Codeausschnitte zu veröffentlichen, deren Hauptzweck die Umgehung der Premium-Prüfung von Porn Fetch ist. Unabhängige Diskussion, Kritik, Sicherheitsforschung und unabdingbare gesetzliche Rechte bleiben unberührt. Personen, die diesen Bedingungen nicht zugestimmt haben, werden dadurch nicht gebunden.

5. User Responsibilities & Legal Compliance / Nutzerpflichten & Rechtskonformität

You are solely responsible for ensuring that your use of Porn Fetch complies with all applicable laws and regulations in your jurisdiction, including but not limited to:

• Copyright and intellectual property law (Urheberrecht) — You must ensure that downloading any content does not violate copyright, neighboring rights, or other intellectual property rights of third parties. I do not encourage or endorse the downloading of copyrighted material without authorization.
• Terms of service of third-party websites — You acknowledge that using this tool to download content from platforms that prohibit such downloading may constitute a breach of those platforms' terms of service. You must comply with the terms, conditions, and policies of each respective website.
• Rights of third parties — You must respect the rights of content creators, rights holders, and platforms. Any use of downloaded content must comply with applicable licensing terms and local regulations.
• Local laws and regulations — Laws regarding the downloading and use of online content vary by country and jurisdiction. It is your sole responsibility to understand and comply with the laws applicable in your location.

I assume no liability for any consequences arising from users' violation of applicable laws, third-party rights, or third-party terms of service.

Sie sind allein verantwortlich dafür, dass Ihre Nutzung von Porn Fetch allen geltenden Gesetzen und Vorschriften Ihres Landes entspricht, einschließlich, aber nicht beschränkt auf: Urheberrecht und geistiges Eigentum, Nutzungsbedingungen von Drittanbieter-Webseiten, Rechte Dritter sowie sämtliche lokalen Gesetze und Vorschriften. Ich übernehme keinerlei Haftung für Folgen aus Verstößen der Nutzer gegen geltendes Recht, Rechte Dritter oder Nutzungsbedingungen Dritter.

6. Third-Party Website Countermeasures / Schutzmaßnahmen Dritter

You expressly acknowledge and agree that third-party websites may, at any time and without prior notice, implement technical countermeasures, change their systems, block access, modify their APIs, or take other protective measures that may prevent, restrict, or invalidate the functionality of Porn Fetch — in whole or in part. I make no guarantee of continued or uninterrupted functionality with any specific website or service. Such changes by third parties do not constitute a defect of the Software and do not give rise to any claims against me (including, but not limited to, warranty, refund, or damages claims).

Sie erkennen ausdrücklich an, dass Drittanbieter-Webseiten jederzeit und ohne vorherige Ankündigung technische Schutzmaßnahmen einführen, ihre Systeme ändern, den Zugang sperren, ihre APIs modifizieren oder sonstige Maßnahmen ergreifen können, die die Funktionalität von Porn Fetch ganz oder teilweise verhindern, einschränken oder unwirksam machen. Ich gebe keine Garantie für die fortlaufende oder unterbrechungsfreie Funktionsfähigkeit mit einer bestimmten Webseite oder einem bestimmten Dienst. Solche Änderungen durch Dritte stellen keinen Mangel der Software dar und begründen keinerlei Ansprüche gegen mich (einschließlich, aber nicht beschränkt auf Gewährleistungs-, Erstattungs- oder Schadensersatzansprüche).

7. Right of Withdrawal — Waiver / Widerrufsrecht — Verzicht

Important / Wichtig:

In accordance with Art. 16(m) of EU Directive 2011/83/EU and § 356 Abs. 6 BGB, the 14-day right of withdrawal does not apply to the supply of digital content not on a tangible medium if the following conditions are cumulatively met:

1. You have given your express prior consent to the beginning of performance (delivery of the license key / download) before the expiration of the 14-day withdrawal period.
2. You have acknowledged that by giving such consent, you lose your right of withdrawal once performance has begun.
3. I provide you with a confirmation of your consent and acknowledgment on a durable medium (e.g., order confirmation email).

By completing a purchase and checking the required consent checkbox during checkout, you expressly agree to the immediate delivery of the digital product and acknowledge that you thereby waive your 14-day right of withdrawal (Widerrufsrecht) in accordance with the above provisions.

Gemäß Art. 16 lit. m der EU-Richtlinie 2011/83/EU und § 356 Abs. 6 BGB entfällt das 14-tägige Widerrufsrecht bei der Lieferung digitaler Inhalte, die nicht auf einem körperlichen Datenträger geliefert werden, sofern Sie Ihre ausdrückliche Zustimmung zum Beginn der Vertragsausführung vor Ablauf der Widerrufsfrist erteilt, die Kenntnisnahme des Verlusts des Widerrufsrechts bestätigt und eine Bestätigung auf einem dauerhaften Datenträger erhalten haben. Mit Abschluss des Kaufs und Aktivierung der erforderlichen Einwilligungs-Checkbox erklären Sie sich ausdrücklich mit der sofortigen Lieferung des digitalen Produkts einverstanden und bestätigen, dass Sie hiermit auf Ihr 14-tägiges Widerrufsrecht verzichten.

8. Limitation of Liability / Haftungsbeschränkung

The following liability provisions apply in accordance with German law (§§ 276, 309 Nr. 7 BGB):

1. Unlimited liability: I am liable without limitation for damages resulting from intentional misconduct (Vorsatz), gross negligence (grobe Fahrlässigkeit), injury to life, body, or health, fraudulent concealment of defects, claims under the Product Liability Act (Produkthaftungsgesetz), and any guarantees expressly assumed.
2. Limited liability for essential obligations: In cases of simple negligence (einfache Fahrlässigkeit) in the breach of essential contractual obligations (Kardinalpflichten / wesentliche Vertragspflichten), my liability is limited to the typical, foreseeable damage (vertragstypische, vorhersehbare Schäden). Essential contractual obligations are those whose fulfillment is necessary to achieve the purpose of the contract and on whose compliance you may regularly rely.
3. Exclusion for non-essential obligations: Liability for simple negligence in the breach of non-essential contractual obligations is excluded.
4. Statutory mandatory liability remains unaffected in all cases.

Die vorstehenden Haftungsregelungen gelten nach deutschem Recht (§§ 276, 309 Nr. 7 BGB). Eine unbeschränkte Haftung besteht für Vorsatz, grobe Fahrlässigkeit, Verletzung von Leben, Körper oder Gesundheit, arglistiges Verschweigen von Mängeln, Ansprüche nach dem Produkthaftungsgesetz und ausdrücklich übernommene Garantien. Bei einfacher Fahrlässigkeit und Verletzung wesentlicher Vertragspflichten ist die Haftung auf den vertragstypischen, vorhersehbaren Schaden begrenzt. Die gesetzliche Pflichthaftung bleibt in allen Fällen unberührt.

9. No Guarantee of Error-Free Operation / Keine Garantie fehlerfreier Funktionsweise

The Software is provided without any guarantee or claim of error-free operation. While I strive to maintain a high quality of the Software, I do not warrant that the Software will function without interruptions, errors, bugs, or defects. The Software may contain errors and may not perform as expected in all environments or configurations. Use of the Software is at your own risk.

This does not affect your statutory warranty rights under §§ 327 ff. BGB (Digital Content Directive / Digitale-Inhalte-Richtlinie), including the requirement that the Software conforms to the agreed-upon specifications and reasonable consumer expectations at the time of provision.

Die Software wird ohne Garantie oder Anspruch auf fehlerfreie Funktionsweise bereitgestellt. Obwohl ich eine hohe Qualität der Software anstrebe, gewährleiste ich nicht, dass die Software ohne Unterbrechungen, Fehler oder Mängel funktioniert. Ihre gesetzlichen Gewährleistungsrechte nach §§ 327 ff. BGB (Digitale-Inhalte-Richtlinie) bleiben hiervon unberührt.

I do not encourage, condone, or facilitate the violation of any applicable law or any third party's rights. The Software is intended for lawful use cases, such as downloading content for which the User has proper authorization or which is publicly available without access restrictions.

Porn Fetch steht in keinerlei Verbindung zu, wird nicht unterstützt von und ist in keiner Weise offiziell mit einer Video-Hosting-Plattform, einer Webseite für Erwachsene oder einem Inhaltsanbieter verbunden. Ich ermutige, billige oder erleichtere nicht die Verletzung geltender Gesetze oder Rechte Dritter.

12. Severability / Salvatorische Klausel

Should any provision of these ToS be or become invalid, unenforceable, or void, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose of the invalid provision (§ 306 BGB).

Sollte eine Bestimmung dieser AGB unwirksam sein oder werden, berührt dies nicht die Wirksamkeit der übrigen Bestimmungen. Die unwirksame Bestimmung wird durch eine wirksame ersetzt, die dem wirtschaftlichen Zweck der unwirksamen Bestimmung am nächsten kommt (§ 306 BGB).

13. Governing Law & Jurisdiction / Anwendbares Recht & Gerichtsstand

These ToS are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers within the EU, mandatory consumer protection provisions of the consumer's country of residence shall apply in addition, to the extent that they provide a higher level of protection. For merchants (Kaufleute), the exclusive place of jurisdiction is Lutherstadt Wittenberg, Germany.

Diese AGB unterliegen dem Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts (CISG). Für Verbraucher innerhalb der EU gelten zusätzlich die zwingenden Verbraucherschutzbestimmungen des Wohnsitzlandes, soweit diese einen höheren Schutz bieten. Für Kaufleute ist der ausschließliche Gerichtsstand Lutherstadt Wittenberg, Deutschland.
